1. Acceptance of Terms

By accessing and using the handyjohnny.com website and/or requesting services from Handy Johnny, you agree to be bound by these Terms of Service. 2. Services Description

Handy Johnny provides professional handyman and home repair services in the Bay Area, including but not limited to: plumbing repairs, painting, flooring installation, remodeling, electrical work, furniture assembly, and general home maintenance. Services are offered Monday through Saturday, 8:00 AM to 10:00 PM, and are available in specified service areas only.

3. Service Availability and Scheduling

Service availability is subject to technician availability, project complexity, and current demand. We will make reasonable efforts to accommodate requested service dates and times. Final scheduling is confirmed via phone or email. We reserve the right to decline service requests that fall outside our service areas or capabilities. Confirmation of service does not guarantee completion on the scheduled date if unforeseen circumstances arise.

4. Free Estimates

We offer free, no-obligation estimates for most projects. Estimates are provided based on information available at the time of assessment and are valid for 30 days unless otherwise specified. Actual costs may differ from estimates due to:

• Unforeseen issues discovered during work
• Additional materials or labor required
• Changes requested by the customer
• Damage to existing structures or fixtures

Any significant cost increases will be communicated to you before proceeding with additional work.

5. Payment Terms

Payment for services is due upon completion unless other arrangements have been agreed upon in writing. We accept: cash, credit cards (Visa, Mastercard, American Express), debit cards, and checks. A service fee of 3% applies to credit card payments. Payment must be made within 30 days of invoice date. Unpaid invoices may be subject to a late fee of 1.5% per month or the maximum allowed by law, whichever is less.

6. Cancellation and Rescheduling Policy

Customer Cancellations:

• Free cancellation: 48+ hours before scheduled service
• 50% of estimated service fee charge: Cancellation with 24-48 hours notice
• 100% of estimated service fee charge: Cancellation with less than 24 hours notice or no-show

Company Cancellations:

If we cancel due to circumstances within our control, we will reschedule at no charge. Emergency situations beyond our control may require rescheduling at a mutually agreed time.

7. Warranty and Guarantees

We warrant that all work performed will be completed in a professional and workmanlike manner using quality materials. Most services are warranted for 30 days from completion. If defects are found within the warranty period and are due to our workmanship, we will make corrections at no additional cost. Warranty does not cover:

• Customer-requested modifications to original work
• Damage caused by customer misuse or neglect
• Normal wear and tear
• Issues caused by third parties or contractors
• Pre-existing conditions not identified in the estimate

8. Customer Responsibilities

The customer agrees to:

• Provide safe access to the work area
• Clear the work area of personal items and clutter
• Disclose known hazards or issues (asbestos, lead paint, structural problems, etc.)
• Ensure utilities (water, electricity, gas) are accessible
• Provide accurate information about the project scope
• Make timely decisions regarding additional work or changes

9. Limitation of Liability

To the maximum extent permitted by law, Handy Johnny's total liability to you shall not exceed the total amount paid for the specific service that gave rise to the claim. We are not liable for:

• Indirect, incidental, consequential, or punitive damages
• Loss of use, data, profits, or business interruption
• Damage to property not part of our service scope
• Issues caused by building code violations or non-compliance by others
• Third-party damages or claims

10. Insurance and Licensing

Handy Johnny maintains appropriate liability insurance and holds all necessary licenses required to operate in California. Our technicians are trained and insured. However, customers are responsible for their own property insurance. We recommend notifying your homeowner's insurance before major renovation or repair work.

11. Dispute Resolution

In the event of a dispute concerning the quality of work or charges, the customer agrees to:

1. Notify us in writing within 30 days of service completion
2. Provide detailed description of the concern
3. Attempt to resolve the issue through good-faith discussion with our management
4. Allow us reasonable opportunity to inspect and remedy the issue

If the dispute cannot be resolved, both parties agree to pursue binding arbitration in Alameda County, California, rather than litigation.

12. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of Handy Johnny or its content suppliers and is protected by copyright law. You may not reproduce, distribute, or transmit any content without our prior written permission.

13. User-Generated Content
